1.About these terms
These terms are the agreement between you and SOH Studio for the use of SOH Motion. Using the editor, with or without an account, means accepting them.
They are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute about them.
2.Using SOH Motion
You may use the editor to make videos, for yourself or for a client, commercially or otherwise. No account is needed to do it, and holding one does not change what you are allowed to make.
You must not use the service to break the law, to infringe anyone's rights, or to make material that is unlawful, harassing or hateful. We can end access for an account doing any of those.
3.Your content stays yours
The pictures, clips, words and finished videos you bring or make are yours. We claim no ownership of any of it.
Saving work to your library gives us the permission we need to store it and show it back to you, and nothing beyond that. We do not use your content to promote the product, we do not show it to anyone else, and we do not train anything on it.
You are responsible for having the right to use what you put in. Where you do not own a photograph or a piece of footage, the licence for it is between you and whoever does.
4.What you make with the templates
The videos you export are yours to use however you like, including commercially, with no credit required and no further fee.
That licence covers what comes out of the editor. It does not extend to the templates, the editor, or anything else in the section below.
5.What belongs to us
SOH Motion (the editor, the template library, the motion in each template, the source code, the interface, the name and the look of it) belongs to SOH Studio and is protected by copyright and other rights. Your right to use it is a licence to use the service, not a transfer of anything in it.
So that this is not left to inference, and whether or not you hold an account, you must not:
- copy, republish or redistribute the software, the templates or any part of the service;
- reverse engineer, decompile or disassemble it, or defeat a technical measure in it, except so far as the law expressly allows despite an agreement saying otherwise;
- use it, or anything extracted from it, to build or train a product that competes with it, including deriving a template library, a parameter set or an editor from ours by automated means;
- scrape, crawl or bulk-download the service, or take it apart with automated tools;
- resell the service, or give someone else access to your account.
6.Accounts
You are responsible for what happens through your account and for keeping your password to yourself. Tell us at hello@soh.studio if you think someone else has it.
You can close your account whenever you like, from Settings. Closing it deletes your projects and the media saved to them, and ends any plan held on it (see Paying for a plan). Download anything you want to keep first; Settings can download every project at once.
We can suspend or close one that breaks these terms, and where it is reasonable to do so we will say why first.
7.Paying for a plan
Prices are shown before you buy, in your own currency where we support it. Prices in euros and pounds include VAT where it applies. Prices in dollars do not include sales tax, which is worked out from your billing address and added at checkout.
A monthly plan renews each month until you cancel. Cancelling stops the next payment and leaves you the month already paid for; we do not refund a month part-way through. A one-off lifetime purchase is not a subscription and is not charged again.
Buying a lifetime plan while a monthly one is running cancels the monthly one at the end of the month you have paid for, so you are never charged twice for the same thing.
A plan belongs to the account it was bought on. It cannot be transferred to another account, and it ends when that account is closed. If you close an account with a monthly plan, the plan stops and is not charged again. If you close an account with a lifetime plan, the lifetime plan ends with it: it is not refunded, and it cannot be restored or moved to another account afterwards, including a new account made with the same email address. We ask you to confirm this before an account holding a lifetime plan is closed.
Payments are handled by Stripe, and their terms apply to the payment itself. Nothing here affects your statutory rights as a consumer.
8.Availability, and what we do not promise
We work to keep the service up, but we do not promise it will be uninterrupted or faultless, and we may change or withdraw features. Exporting depends on your own browser and machine, and not every capability exists in every browser.
The service is provided as it is. So far as the law allows, we exclude the implied warranties that would otherwise apply.
Keep your own copies of work that matters to you. Any project downloads as a folder of ordinary files, one at a time or all together, and that is the copy that does not depend on us.
9.Liability
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit.
Otherwise we are not liable for lost profits, lost business, lost data or any indirect loss, and our total liability to you is limited to what you have paid us in the twelve months before the claim; or, where you have paid us nothing, to £100.
10.Changes to these terms
We may update these terms. The date at the top changes when we do, and where a change is significant we will tell account holders by email before it takes effect. Continuing to use the service after that is acceptance of the new version.
