  1. 1.About this page

    SOH Motion respects other people's copyright and expects the people who use it to do the same. This page says how to tell us that something on the service infringes your copyright, and what we do when you tell us.

    It covers two things: what we publish ourselves (the site, the editor, the templates, and the pictures and music shown with them) and what people save to their accounts.

  2. 2.What is ours

    The editor, the templates and the motion in them are our own work and are protected by copyright. The terms say what you may and may not do with them, and with the videos you export.

    Some of the pictures and music shown on the site are licensed to us by other people and remain theirs.

  3. 3.What people save

    Work saved to an account is private. Only that account can open it, and we do not publish it. Each person is responsible for having the right to use what they save, and the terms require it.

    Because saved work is not public, a report about it should give us whatever helps us find it: the account's email address if you know it, what the material is, and where you saw it used.

  4. 4.Reporting an infringement

    Write to hello@soh.studio, in English, with “Copyright notice” in the subject line. Include:

    • your name, postal address, telephone number and email address;
    • the work you say has been copied, or a link to it;
    • what on SOH Motion you say infringes it and where it is: a page address, or the details above for something saved in an account;
    • why you believe it infringes;
    • a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
    • a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them;
    • your signature, which can be your full name typed.

    That list is what the European Union's Digital Services Act and the United States' Digital Millennium Copyright Act (DMCA) each ask a notice to contain.

  5. 5.What we do with a notice

    We confirm that your notice has arrived, a person reads it, and we tell you what we decided. Nothing is decided automatically.

    Where a notice is valid, we promptly remove the material or switch off access to it. If it was saved in an account, we tell the account holder what was removed and why, and how to object.

  6. 6.If your material was removed by mistake

    Write to the same address with:

    • your name, postal address, telephone number and email address;
    • what was removed, and where it was before;
    • a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or because it was misidentified;
    • a statement that you accept the jurisdiction of the federal district court for your address or, if you are outside the United States, of any judicial district in which SOH Studio may be found, and that you will accept service of process from the person who sent the notice;
    • your signature, which can be your full name typed.

    We send a copy to the person who complained. Unless they tell us within 10 to 14 business days that they have gone to court over it, we may put the material back.

  7. 7.Repeat infringement

    We close the account of anyone who repeatedly infringes copyright, whether through what they save or by copying our templates.

  8. 8.False claims

    A notice, or a reply to one, that knowingly misstates the facts can make its sender liable for the damage it causes, including legal costs. Under the DMCA that is section 512(f). If you are unsure whether something infringes, take advice before sending one.
